End User License Agreement

This End User License Agreement (EULA) constitutes a legal contract between you, either individually or on behalf of your business entity, and MineStoreCMS. Prior to installing any of our products, you must carefully read and understand this EULA. By proceeding with the installation of our software, you acknowledge and agree to the terms outlined in this EULA and are thereby bound by its provisions, including those related to termination, warranty information, and disclaimers.

If you do not agree to these terms, do not install the software. Your continued use of the software signifies your acceptance of these terms and any subsequent modifications. We reserve the right to amend these terms, but we will provide advance notice of any changes, allowing you adequate time to decide whether to continue using our products. It is important to note that, while you do not acquire ownership of MineStoreCMS, your purchase grants you a license to use it in accordance with the terms of this EULA.

1. License Grant

1. Scope of License: This EULA grants you a non-exclusive, non-transferable license to use MineStoreCMS on a single domain for personal or commercial purposes. You may not sublicense, distribute, or transfer the software to any third party without our express written consent.
2. Restrictions: You may not reverse engineer, decompile, or disassemble the software, nor may you modify, adapt, or create derivative works based on the software. You may not remove any proprietary notices or labels from the software, nor may you use the software for any illegal or unauthorized purpose.
3. Customizing: You may customize the software to suit your needs, but you may not distribute or sell these modifications without our express written consent. You may not use the software to create a competing product or service, nor may you use it in a manner that violates the rights of any third party.

• 3.1: You may change and edit source code files as long as you do not remove the license system or any other security features.
• 3.2: You may not remove the copyright notice without purchasing a copyright removal license.

4. Limitations: This license does not grant you the right to use the software in a manner that violates the rights of any third party, nor does it grant you the right to use the software in a manner that is inconsistent with the terms of this EULA.

• 4.1: You may change domains once every year. If you need to change domains more than once a year, you will need to purchase a domain change service.
• 4.2: You receive support and updates for 1 year from the date of purchase. After this period, you will need to renew your license to continue receiving support and updates.
• 4.2.1: You may continue to use the software after the support and updates period has expired, but you will not be entitled to receive support or updates.

5. Ownership: MineStoreCMS is owned by MineStoreCMS and is protected by copyright laws and international treaties. You acknowledge that MineStoreCMS retains all rights, title, and interest in and to the software, including all intellectual property rights.
6. License Ownership: The software is licensed to you and only you. You may not transfer, sell, or assign your license to any third party without our express written consent.

• 6.1: This license is valid only for the domain provided during the purchase. If you need to change the domain, you will need to purchase a domain change service.
• 6.2: You may not use the software on multiple domains without purchasing additional licenses.
• 6.3: If more than one person (or company) will be using the software, each party must purchase a separate license.

2. Support

1. We provide support services to customers who have purchased a valid license. Support services include assistance with installation (excluding installation by us) and troubleshooting. We do not provide support for theme/template customizations or third-party plugins.
2. For custom setups or specific VPS configurations that deviate from the official requirements and standard web configurations (such as Plesk, cPanel, ISPManager, or other web server panels), support may be limited. While we will make every effort to assist, we cannot guarantee resolution of all issues in such cases.
3. Assistance provided does not equate to performing tasks on your behalf. We will offer guidance and instructions on how to complete the required actions; however, we will not execute these tasks for you.
4. Installation services are not included with the purchase of a license. We provide very detailed installation instructions that you can follow to install the software on your server. If you are unable to install the software, you may purchase installation services.
5. We reserve the right to discontinue support for older versions of our software. If you are using an outdated version, we recommend updating to the latest version to ensure compatibility and security.
6. We reserve the right to modify, suspend, or discontinue support services at any time. We will provide advance notice of any changes to our support services, allowing you adequate time to decide whether to continue using our products.
7. The customer understands that our free support may have a delayed response time.
8. We reserve the right to refuse support to customers who violate the terms of this EULA or engage in abusive behavior towards our support staff.
9. We reserve the right to refuse support for customers who have modified the source code of the software if such modifications caused the issue.
10. Support may be provided only for the latest version of the software. If you are using an older version, you may be asked to update to the latest version before receiving support.
11. Support may be provided only if installation was done according to the official installation instructions (automatic installer). If you have installed the software in a different manner, you may be asked to reinstall using the official installation instructions before receiving support.
12. We provide support via our official Discord server. You can join our Discord server by visiting Discord Server.
13. In case if MineStoreCMS closes down or becomes discontinued for any reason, support will no longer be provided. You will still be able to use the software, but you will not receive any support.
14. Support is provided in English only.

3. Updates

1. We provide updates to our software to ensure compatibility with the latest versions of PHP, SQL, and other server software. Updates may also include new features, bug fixes, and security patches. You are entitled to receive updates and support for 1 year from the date of purchase. After this period, you will need to renew your license to continue receiving updates.
2. You are aware that updates to our products are not guaranteed.
3. We reserve the right to modify, suspend, or discontinue updates at any time. We will provide advance notice of any changes to our update policy, allowing you adequate time to decide whether to continue using our products.
4. We reserve the right to refuse updates to customers who violate the terms of this EULA or engage in abusive behavior towards our support staff.
5. In case if MineStoreCMS closes down or becomes discontinued for any reason, updates will no longer be provided. You will still be able to use the software, but you will not receive any updates.

4. Regulations

Allowed Uses

1. Complete or partial modification of the frontend application (templates, styles, scripts, etc.) is allowed, except for the "Powered by MineStoreCMS" branding, which must remain unless a copyright removal license is purchased.
2. Adding new features or modifying existing features is allowed.
3. Adding new payment gateways or modifying existing payment gateways is allowed.
4. The addition of new plugins or modifications to existing plugins is allowed.
5. Making addons or modifications to the software is allowed.

Prohibited Uses

1. You may not remove or alter any copyright, trademark, or other proprietary notices from any part of the software unless you have purchased a copyright removal license.
2. You may not remove the license system or any other security features from the software.
3. You may not use the software to create a competing product or service.
4. You may not use the MineStoreCMS API, service, code, or any property in a manner not intended by the software.
5. Modifications to the software are allowed (unless stated otherwise in this EULA), but you may not distribute or sell these modifications without our express written consent.

5. License Violation

1. The MineStoreCMS license system interfaces with MineStoreCMS servers to prevent unauthorized or illegal use of the software. You acknowledge and consent to the use of this authentication system, which may (a) monitor your use of the software, (b) suspend or disable access to the software, in whole or in part, in the event of a breach of this agreement, and (c) terminate your use of the software upon expiration or termination of this agreement. You agree not to obstruct, interfere with, or circumvent any operation or component of the license system, including the communication between MineStoreCMS and MineStoreCMS license servers.
2. You agree that MineStoreCMS may conduct an audit of your use of the software to ensure compliance with this agreement, provided reasonable notice is given. You will cooperate fully with MineStoreCMS and any auditors designated by MineStoreCMS to perform the audit. This cooperation includes, but is not limited to, granting access to the locations where the software is stored, as well as the facilities housing the hardware on which the software is installed. Should such an audit uncover any violations of this EULA, you agree to reimburse MineStoreCMS for all reasonable expenses incurred during the audit, as well as for any other liabilities arising from such non-compliance.
3. If you violate the terms of this EULA, your license may be terminated, and you may be subject to legal action. We reserve the right to pursue all available legal remedies to protect our intellectual property rights and enforce the terms of this agreement.
4. We are not obligated to inform you of the reason for the termination of your license. We reserve the right to terminate your license at any time, with or without cause.
5. If your license is terminated, you must immediately cease using the software and destroy all copies of the software in your possession. You may be required to provide proof of destruction to MineStoreCMS upon request.

6. Refund Policy

1. Since the items the customer receive when purchasing are Digital Intangible Items, we uphold a strict no refund policy. This policy is in place to protect the intellectual property rights of the software and to prevent unauthorized use of the software.
2. The customer agrees that no refunds will be available after purchasing the product or services.
3. The customer agrees that executing a chargeback/dispute will get them suspended from buying all of our products or services.

7. Force Majeure

1. MineStoreCMS shall not be liable for any failure to perform its obligations under this agreement if such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, or natural disasters.
2. By using our products, you grant us indemnity against all liabilities, including but not limited to costs, expenses incurred, damages, and losses (including but not limited to direct or indirect consequential losses), loss of profits, penalties, legal costs, loss of reputation or interest, and loss of business. We are in no way liable for any presenting or hidden circumstances that may occur from using our software.
3. Any data sent to us or used on our products that is non-confidential (while we collect minimal data like this) can be used, modified, displayed, or transmitted. We are not responsible for any data that is sent to us or used on our products.
